Liability of Strangers to the Trust

As a general principle, only trustees are liable for breach of trust. Trustees hold fiduciary duties and are personally accountable for any breach. A stranger to the trust — someone who is not a trustee and has not assumed fiduciary responsibilities — is not automatically liable for a trustee's breach.
