Trusts of the Family Home and Proprietary Estoppel

A trust imposed by the court where the legal owner(s) of property and another person had a shared intention about how beneficial ownership should be held. The court gives effect to that shared intention by declaring that the property is held on trust for both parties in specified shares. It arises entirely by operation of law — there is no formal trust instrument.
