The four main defences are: (1) Volenti non fit injuria (consent) — a complete defence; (2) Contributory negligence — a partial defence reducing damages; (3) Illegality (ex turpi causa) — may bar the claim entirely; (4) Exclusion of liability — contractual attempts to limit or exclude liability, subject to statutory controls.
