A breach occurs when the defendant falls below the standard of care expected of them. Once a duty of care has been established, the claimant must prove on the balance of probabilities that the defendant's conduct was unreasonable. Breach is the second element in a negligence claim — without it, the claim fails even if duty exists and damage was suffered.
