Sarah is a first-time buyer purchasing a residential property in Bristol. Her solicitor, James, sends her the draft contract which states it incorporates the Standard Conditions of Sale (5th edition). Sarah asks James what this means and whether these conditions are actually written out in her contract. James explains that the Standard Conditions are incorporated by reference and apply even if not written in full. He tells Sarah these conditions set out default rules for the transaction unless varied by special condition.
